2. Definitions
- Client / User: Person or business using our services.
- Services: All digital marketing, design, branding, development, video/photo production and other solutions provided.
- Content: All creative or digital materials produced or shared.
3. Eligibility
By using our services, you confirm that:
- You are 18+ years of age.
- You have legal authority to enter into a contract.
4. Scope of Services
Creativephy provides the following services. We may add, modify or discontinue services without prior notice.
- Social Media Management
- Branding & Designing
- Web Development
- SEO & Performance Marketing
- Video & Photo Production
- Content Creation & Business Consultation
5. Payments & Billing
- All payments must be made in advance, unless officially agreed otherwise.
- No refunds will be processed once a project or campaign has started.
- Delayed payments (7+ days) may cause service suspension.
- GST & government-applicable taxes will be added as required.
6. Project Timelines
Timelines depend on client’s timely approvals, content/resource availability, and technical delays. Client-side delay will extend the timeline automatically.
7. Client Responsibilities
The client must provide accurate information and brand material, approve drafts on time, and ensure no illegal, copyrighted or policy-violating material is provided.
7.1 Digital Documents & Approvals
All approvals via email, WhatsApp, or other digital modes are considered legally valid under the IT Act, 2000 (India).
7.2 No Physical Meetings
Creativephy Pvt. Ltd. operates through a complete digital workflow. No physical visits, document submissions, or in-person meetings are required.
If a client requests an offline (in-person) meeting, then:
- Advance consultation charges will apply.
- Charges vary based on location, travel distance, time, and destination.
- If services are taken after the meeting, the consultation amount will be adjusted in the final cost.
8. Intellectual Property Rights
- All raw files, source files, project files, PSDs, AIs, codes remain Creativephy’s property unless purchased separately.
- Final deliverables belong to the client only after full payment.
- Creativephy may showcase completed work in its portfolio unless a written request states otherwise.
9. Confidentiality & Data Protection
Both parties must protect confidential information. We follow Google Policy, Indian IT Act, and secure digital standards. No data is sold or shared. By using our services, you accept our Privacy Policy.
11. Third-Party Platforms
Creativephy uses platforms like Meta, Google, etc. We are not responsible for policy violations caused by client content, ad disapprovals, or platform downtime. Clients must follow Google/Meta advertising guidelines.
12. Limitation of Liability
Creativephy will not be liable for business loss, profit loss, or indirect damages. Our maximum liability is limited to the amount paid in the previous 30 days.

13. Governing Law
These Terms follow the laws of India (Indian Contract Act 1872, IT Act 2000). Any dispute will fall under Delhi jurisdiction.
